Stephen may: An innocent man

Stephen's Story

Stephen May's case is a harrowing tale of injustice that should shake the foundations of our legal system. This man, with no criminal history, faces a staggering 75-year sentence. 


The trial was a mockery of justice, riddled with errors and based on an unconstitutional law. Even as the jury deadlocked, unable to reach a verdict, the state pressed on with its flimsy case. 


Federal judges have since recognized the grave miscarriage of justice, with one dedicating a book to Stephen and another highlighting the questionable evidence. In a brief glimmer of hope, Stephen was freed when a district court judge granted him habeas corpus, only to be cruelly returned to prison on a technicality. The legislature, recognizing the injustice, amended the very law used to convict him. 


Now, a recent autism diagnosis is shedding new light on Stephen’s case. However, Stephen has already served 15 years – equivalent to the original plea offer. Barring intervention, this innocent man faces 60 more years, condemned to die behind bars for a crime that never happened.

The State deprived May of his constitutional right to due process of law and proof of guilt beyond a reasonable doubt.... Arizona spared itself from proving sexual intent and instead burdened May with disproving it.

A Second Chance: A Federal Judge Decides Who Deserves It
